GP Terms and Conditions
General Practitioner Terms and Conditions ("GP Terms")
At MyMed, our mission is to improve access and efficiency in healthcare. High quality care is our number one priority. The way MyMed works is simple: we are a clinician founded company with a strong belief in free universal access to healthcare. We hold ourselves to the highest possible legal and ethical standards and we will never jeopardise your trust in us by failing to live up to these values. IF YOU DO NOT UNDERSTAND, ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS YOU ARE NOT AUTHORISED TO ACCESS OR USE MYMED, IN ANY WAY, AND YOU SHOULD LEAVE, EXIT, END YOUR SESSION, OR CLOSE YOUR CONNECTION IMMEDIATELY.
By acknowledging and accepting the GP Terms, you agree the following:
(a) to comply with all applicable laws, regulations including Data Protection laws and all professional codes of conduct and regulations that apply when practicing and a General Practitioner, (‘GP’);
(b) to hold professional indemnity insurance and to have notified your indemnity provider of the nature of the work to be undertaken with MyMed;
(c) NOT to diagnose or treat any person under the age of 18 years, including by proxy, by for example advising the child’s parent;
(d) to provide, when accepted and having had your GP account activated by MyMed, a professional and transparent service when you are available that complies with (i) the General Medical Council Guidelines on remote prescribing, essential standards of quality and safety as interpreted by the Care Quality Commission and clinical best practice in the UK; or (ii) the Medical Council Guide to Professional Conduct and Ethics for Registered Medical Practitioners, Seventh Edition 2009, and clinical best practice in Ireland;
to volunteer, where requested in a consultation, your name and General Medical Council / Irish Medical Council professional registration number when prescribing medicines and communicating with patients;
(f) to prescribe medicines only when in your professional judgment it is in the patient's best interests to receive the medicine being requested and, accordingly, to refuse to prescribe medicines when you believe it is not in the patient's best interests to receive medicines without the benefit of a face to face consultation;
(g) to show patients their nearest face-to-face GP services using our Site (www.mymedhealthcare.com) and App services to do so, and to encourage their consultation at these establishments instead, whenever you feel this is more clinically appropriate than your online consultation;
(h) to take all reasonable steps to protect patients' personal information and comply with Data Protection laws;
(i) to not engage with MyMed services from any place outside the United Kingdom, including circumstances where you have reason to believe the patient may be using the Services from outside the United Kingdom;
(j) to not allow any other person or party access to your MyMed account, nor disclose any security or login data that might allow another party to access MyMed under false pretenses;
(k) to allow MyMed to share your identification details and scanned signature over a secure connection with its pharmacy partners for the purposes of secure prescription authentication;
(l) that the signature scanned from your uploaded identification document is a current likeness of your signature and that you approve its use as such - for the prescribing of medicines remotely - as and when you approve a prescription be signed by you on our Site or App; and
(m) to enter an appropriate clinical summary at the end of each consultation, and to allow MyMed to send the details (with permission of the patient, which is part of our user terms) of each consultation and treatment to a patient's regular GP if they are registered with one. Our system enables an easy summary to be entered at the end of each consultation, and providing you have entered information and approved its sending, a letter is generated which the MyMed team will send to the appropriate registered GP on your behalf.
You also agree to allow MyMed to take reasonable steps to confirm your identity and training with the appropriate Professional Bodies; this will be done prior to account activation and requires that you upload the requested documentation first.
PROVISION OF THE SERVICES
In accepting the GP Terms you accept the terms of the Investment Cash Token Scheme as detailed in Rewards Schedule 1.
In the interest of introducing a safe and effective service, you should not prescribe the following with MyMed;
- Any medicines classed as controlled or restricted drugs/substances under the The Misuse of Drugs Regulations 2001;
- Unlicensed medications;
- Sedatives or sleeping tablets;
- Strong analgesics;
- Medications that need to be initiated by a hospital consultant specialist.
You acknowledge on a professional basis that MyMed is NOT to be used in an EMERGENCY situation, and that if you believe that a person you are consulting with is in an urgent or emergency situation, you should immediately tell the patient to dial 999 and immediately cease your use of MyMed. A patient who is able to use MyMed chat consultation should also be capable of dialling emergency services, and continued use of the consultation Service in such an emergency situation is inappropriate and breaches our Terms.
You expressly understand, accept and agree that when using the Site or App you do so as an independent medical professional who is individually responsible for the medical advice, diagnoses and medical services that you offer via the Site or App.
You acknowledge that the ownership of all intellectual property rights in the Site or App shall remain vested in MyMed at all times.
LIMITATION OF LIABILITY & INDEMNITY
MyMed shall not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise arising under or in connection with this Agreement or the Services provided by you for any direct, indirect or consequential losses.
You shall indemnify MyMed and keep MyMed indemnifies from and against all losses, damages, liabilities, claims, costs and expenses (including reasonable legal costs) which are incurred and/or suffered by MyMed arising out of or in connection with the Services that you provide to patients using the Site or the App; the advice you give during consultations; breach of Data Protection laws and any breach of your obligations under the terms of these GP Terms.
MyMed may terminate your use of the Site or App as follows:
a. for convenience on 30 days written notice;
b. immediately if there is a material breach by you of the terms of these GP Terms;
c. if you cease to hold a practicing certificate or professional indemnity insurance or are not indemnified to carry out the services to MyMed;
d. if you fail to notify the MPS/MDU/MDDUS of the services you are providing to MyMed.
You may not sub contract or use a locum to carry out the Services.
These GP Terms and the Terms constitute the entire agreement between MyMed and you and supersede and extinguish all previous drafts, agreements, arrangements and understandings between the parties, whether written or in oral form.
The parties are independent contractors and nothing in these GP Terms is intended or shall be deemed to establish any partnership or joint venture between them, constitute any person as the agency or another, nor authorize the other party to make or enter into any commitments for or on behalf of any other.
If any provision or part-provision of this Agreement is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification of a provision or part provision shall not affect the validity and enforceability of the rest of these GP Terms.
Governing law and Jurisdiction: These GP Terms and any dispute or claim between MyMed and you arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle such disputes or claims.
Rewards Schedule 1:
Investment Cash Token Scheme: As an early GP, you will automatically be initiated onto our Investment Cash Token Scheme. You will directly receive your chosen prescription fee on completion of prescription purchase by the patient, and in addition, for each consultation you perform (regardless of prescription or lack thereof), you will earn a reward as detailed below.
Signed up GPs on the Investment Cash Token Scheme gain cash tokens according to their level of engagement. The level of reward at the time of writing is outlined below:
10 consultations = cash tokens worth £200 post-investment*
50 consultations = cash tokens worth £1000 post-investment*
At >50 consultations; our team will contact you personally for further reward scheme discussions
*The caveat here is that we are aiming to grow this company with your help; your cash tokens will be bought back from you at the above value when 1,000 consultations have occurred on MyMed.
Please note that the Investment Cash Token Scheme is an early adopter scheme only, is in addition to any prescription fees earned, and is subject to termination at any time at the discretion of the MyMed management team without prior notice. Notification of alteration in the rewards scheme for GPs will be provided to you and your feedback sought on any changes.
Consultations are marked as complete when a user has marked the end of a chat consultation as completed and/or rated the GP.
